Just received a Request for initial evidence (I-485) related to I-864 in the mail.

 

It says:

"Form I-864 Affidavit of Support, was submitted, however, Page 3, Part 4 of the petitioner/sponsor's Form I-864 list someone other than the petitioner/sponsor or Page 3, Part 4 is blank."

 

Apparently, on the I-864 form, the name (1a, 1b, 1c) was missing from page 3, part 4. The information was automatically deleted when I deleted fields from Part 11 (1a, 1b, 1c), and I hadn't noticed. So I will complete these fields, this question seems to be solved.

 

Next point on the Request for initial evidence, however, says "Form I-864 Affidavit of Support, was submitted from a joint sponsor; however, the names listed on Page 1 and Page 3 are not the same". 

 

This point got me confused! We only submitted one I-864 (the husband for the wife). Is the letter asking me to provide a joint sponsor??? Or must this be only because the info on Page 1 and Page 3 were not similar?

 

Do I submit the supporting documentation again (w-2s, tax returns?)

I intend to correct Part 3, Page 4 and attach the tax returns, W-2s and send it.

 

The second part is still confusing, since it still says to send a form for a joint sponsor. So I wonder if that's generic...

I got the EXACT same RFIE.    I was so confused when I read it. I could have sworn that I filled in that part, so I was so confused when I looked at my copy that it was indeed blank. I did a little search and it looks like other people have had the same problem. Apparently it really is true that when you fill out page 3 park 4, it autofills page 12 part 11.  If you later go and delete page 12 part 11 because you think it is not needed, then it automatically deletes page 3 , part 4!  JEEZ!

 

It also said that the ''form was submitted from a joint sponsor, however, the the names listed on page 1 and page 3 are not the same." and then proceeds to say to submit an 864 from a joint sponsor and all the supporting documents for them.  I never included a joint sponsor in any section, and shouldn't need to as my current income is well over the poverty level for my household size.  Granted, my last few years tax returns reflect a below poverty level income level, but my CURRENT income is over 70K and I had originally submitted paychecks and an employer letter to prove so.  I am thinking that this second part of the letter was just because page 3 part 4 names part was left blank.    I am not going to submit any joint sponsor info because I never did in the first place, and everything that I have researched tells me it is not necessary.  I hope that I won't be making a mistake by not sending it in.  

 

How annoying that a form glitch caused a minor deletion that I didn't catch and now we have a delay with an RFIE.
