the category depends on her marital status, not if she has a child

 

if she is unmarried, due to being a single mom, or divorced or widowed, with or without children she will be an F1

 

only married children, with or without kids are in category F3

 

now, if she is divorced, she will need the father's authorization to take the child out of the country if he or she is under 18 at the time of the interview, because it takes many years of waiting

So what if she has children without married can she bring the children. She didn't have children when we filed for her. In that case, can she bring the children when her priority date comes.

as long as she has full custody and the parent isn't listed on the birth certificate there is no problem

 

she doesn't need to wait until the priority date is current, if the i130 is at the nvc,  the parent can update the case, mailing copy of the birth certificate and stating case number

So she has to send birth certificate of her children to the NVC to update it right. What if she just gave birth but they haven't married yet. If she update the status can they come together. Will she need the father's information on the visa application for the children. They kids are 3 years. Thank you
