Thanks for the updates.  Our PD is March 24th and hoping that because they're already doing April RFE's and we haven't received one yet when they did the March RFE blitz a couple of weeks ago, that we'll get our approval letter very soon.  It would be a nice Christmas present.

If you are legally married and want to file jointly then foreign spouse must have either SSN or ITIN.

12/20/2017 (Wednesday) Received text and email that my case has been accepted and routed to the USCIS Texas Service Center for processing

12/21/2017 (Thursday) Check was cashed. NOA-1 (I-797C) was sent to me by USCIS via USPS.

12/26/2017 (Tuesday) NOA-1 (I-797C) was received.

06/07/2018 (Thursday) NOA-2 was APPROVED. 172 days.

06/11/2018 (Monday) NOA-2 was delivered by USPS to my home address.

06/22/2018 (Friday) Our case was sent to the U.S. Department of State (DOS) for visa processing (NVC)

07/27/2018 (Friday) NVC welcome letter with Case number and Invoice ID number was received by email. (51 days from NOA 2 and 225 days total)

07/31/2018 Fees paid.

08/14/2018 CASE COMPLETED (DOCUMENTARILY QUALIFIED)

09/19/2018 Got email with VISA INTERVIEW DATE

Not necessarily.. My wife and I went through this (we both live abroad btw). I’m the foreign spouse, never lived in the US, never paid tax in the US, which means I have no SSN, nor ITIN. You can not file your taxes online because of that (you can not leave the spous’ ITIN no. blank, the website won’t let you go to the next step without it), but can do it on paper (I guess). What we did is that my wife called IRS, explained the situation and they mail her transcripts to our foreign address. They were very helpful!

My wife and I went through this (we both live abroad btw). I’m the foreign spouse, never lived in the US, never paid tax in the US, which means I have no SSN, nor ITIN. You can not file your taxes online because of that (you can not leave the spous’ ITIN no. blank, the website won’t let you go to the next step without it), but can do it on paper (I guess). What we did is that my wife called IRS, explained the situation and they mailed her transcripts to our foreign address. They were very helpful!

Okay, just asked my wife.. (I was more or less right about it :))

 

You only can do it separately, NOT jointly, as your spouse doesn’t have ITIN.

 

So you have to do it on paper for the reason I explained above. My wife included a note explaining the situation in the same mail she sent to IRS with the tax returns. She was asking them to let her know, but they never answered, so she gave them a call a good few weeks later (I think IRS allow themselves 5 weeks or so). The lady at IRS was very helpful, printed her transcripts and mailed them to our foreign address (she even included a little note wishing us success with the immigration :)).

 

However it was probably easier than usual, as my wife didn’t have any income.

 

Before this, I tried to get my ITIN number with W7 form.. Don’t waste your time with that... (and don’t waste your money either, I had to mail a notarized copy of my passport, the US embassy in my country charged me $50 for that..)

I talked to my accountant. She said it's possible to file jointly (my CPA will take care of it). My wife lives in Brazil, she doesn't have ITIN, I live in the US. You don't need spouse's passport to file W7, you need Power of Attorney (IRS Form 2848).

I can’t argue with that, if your accountant says so, I’m sure it is possible, however I was positive until just now, that your spouse has to have ITIN to do it jointly.

 

That’s why I tried to get my ITIN (I’m the foreign spouse), with W7 form and obviously I have to prove my identity with my passport. (according to the W7 instructions). But you can not just make a copy, it has to be notarized so they make sure it is not fake. Which I already said it was a waist of time.. :)
