Hi everyone,

I am a filipina who was once married in the Philippines to a foreigner. Unfortunately it didnt last. He filed divorce in his home country and I have a copy of the divorce decree but I havent had it recognized in a Philippine court yet. Now my fiance wants to file for a K1 visa, am I qualified to apply for it without having my divorce recognize in Philippine court? Please help.

I have a friend here in Texas, she had the same experience. She was previously married to a Japanese National, who divorced her in Japan. She got a copy of the divorce degree. She was approved both I-129f petition and K-1 interview. She is now married now here in U.S. and waiting for her green card. 

 

U.S. Embassy/USCIS just needs a copy of divorce degree as a justification that your capacity to marry.

Her divorce degree isn't recognized in a Philippine court. She didn't encounter any issues in terms with her USCIS case (fiancee petition and adjustment of status). But she may need it though for Report of Marriage to the Philippine consulate if she chooses to do so.
