Hi!

 

I'm trying to help my joint sponsor fill out form I-864 but am I little confused when it comes to Part 6, Nr 15. "Annual Household Income".

My sponsor files joint tax returns with her husband, but her income is sufficient to sponsor me so we're not counting his income.

Are we supposed to write in the nr thats on line 22 on their joint 1040, or list her individual annual income again as in Part 6, nr 2..?

 

Also, for her individual income - should we write the annual salary listed on her employment letter or do we add dividend funds(she lives in AK) and income from her self employment side-job as well?

This is described on page 7 of the instructions.
Firstly to not include the sponsor's husband's income the individual income of your sponsor must be enough for the household including you, the sponsor and the rest of the sponsor's household (I'm assuming you have entered their household size in the earlier sections). If this individual income is higher than 125% for that household size, you enter only this amount in both individual and household income.

 

This part is really about the current income, that is the anticipated income for the current year and not what the income has been in previous years. It would end up being the same as the latest tax return in the cases where; 

1. nothing happened to the income since then for a single filer sponsor or;

2. nothing happened to the income since then for both spouses filing a joint return and both spouses are included as sponsors.

 

To not include the self-employed income that your sponsor has had, the other income would have to meet the 125% income requirement for the sponsor's household size. If it does not and you need to include the self-employed income then you'll need to submit evidence of this income as well. If you are including the self-employed current individual income then that income should be the anticipated AGI, whereas the non self-employed income should be the anticipated gross income. The combined amount would be used to meet the 125% requirement.

 

To show what is the individual income of the sponsor (assuming their income alone hasn't changed and meets the requirement) you'll need to submit latest tax return (it will not match for a joint return) w2 and schedules etc. (shows how much of the 1040 is individually earned). The amounts entered here should be the anticipated current gross income of the sponsor.

 

Finally, don't confuse this with the items 19a-19c. These should always match exactly the 1040 line 22 or the AGI for 1040EZ for past returns. Self-employed income needs to be AGI also for the 1040.

 

In conclusion, the easiest for you would be if the sponsor's non self-employed income meets the 125% requirement for her household size. Then you would only need to enter her individual anticipated gross income in both current income places and show this by letter of employment, last years filing, current pay stubs and w2 and schedules. Plus entering the joint return line 22 income in 19a-19c.
