Hello all Visajourney friend,

I will be mailing out my spouse I-751 packet next week. And I have searched the forums for answer but can not find a similar case to mine. Here is our case. I hope you guys can answer my questions.

 

We are a resident of the state of Kansas and own a house there. Currently, the house is on the market to be sold. I have copies of our driver license and other documents as evidence from this address. Last year, I came to North Carolina for work and to see if we like it here. We like it here, and is looking to buy a house here. We are renting an apartment in NC and I put this as my "physical address" on the form. But we will be using our god-parents address as our "mailing address" so no mail is lost if we bought a house after I mail out the packet.

I am debating if I need to put down my KS address as my physical and mail the package to USCIS in California. We can change our residency after I work here 1 year (comes mid April) and bought a house in NC.

 

Questions:

1) Can I used my NC address as my physical address and mail my package to USCIS in Vermont? I want to do the biometric and interview in NC. We don't want to drive 18 hours to KS (state of resident) for that.

 

2) Do you think I need to write a letter explaing my addresses issue.

 

My thoughts are getting pulled in two directions and I want to do it correctly the first time. Please help. (Sorry for making it long).

First of all, remember that both of you (sponsor and immigrant) will need to file paperwork to update your address with USCIS every time you move. The immigrant is supposed to file AR-11 (online) within 10 days of the move, and the sponsor needs to file I-865 (by mail) within a month of the move. You may also need to change your state of residence for things like your drivers' license etc. Check out NC's rules about that.

 

But in answer to your questions:

1. Yes, you can have whatever addresses work for you on file, as long as they're accurate.

2. Not a letter, but you will need to fill in the forms either online or by mail as soon as you can, once you have a place (rented or owned).

 

USCIS may still screw it up and assign you for a biometrics appt in KS. If they do, you'll need to file to have the appointment rescheduled, at the new location. I know you can do that but I don't know exactly how.

 

In other related news, CSC is still processing I-751s significantly faster than VSC (although VSC is making up ground, so you never know...) so you might want to keep using KS if that means you get to be processed at CSC

Thank you nightingalejules for your advice and answers.  I really appreciated it.  We have no pending cases to do an AR-11.  I-129 and I-130 is approved while we were at our previous residency address ( State of Iowa).  Since then we have moved to KS to be closer to family.  And now, we are in NC for my work.  We will change our residency to State of NC comes May, because I am on a one year contract.
