Hi everyone. The post office has lost my husband's packet for AOS and EAD, so we have to send it and pay again. My mom who we live with was helping us by filling a I-864A, however she will no longer be helping us. In 2015 and for most of 2016 I was part time at work, not meeting the poverty guidelines. However, now I am full time, 40 hours at $12 an hour, roughly 24,960 not taking away for holidays and taxes. But my recent tax statement won't reflect my full time status- is there a way around this? Or do we need a another sponsor? We are thinking of asking my dad, he will not be able to do a I-864A because we don't live with him, but he can do the I-864. 

 

We meet the poverty guidelines for a hour of 2 which is 20,025, but since we live with my mom is our household size 3? Meaning I would need to make 25,200 in order to not need a joint sponsor? 

 

This link http://www.***removed***/affidavit-of-support/joint-sponsor.html says that "each joint sponsor must individually meet the income requirements according to Federal Poverty Guidelines for his/her household size without combining resources with the petitioning sponsor or second joint sponsor." Would I be the petitioning sponsor since I am filling it out to support my husband? Does that mean I do not have to individually meet the guideline as the quote says? Thanks for any help.

09/28/2017- Sent RIFE Packet 

10/14/2017- Received green card w/ no interview 

07/11/2019- Sent Removal of Conditions Packet

08/07/2019- NOA by text and letter 

11/07/2019- Fingerprints taken

12/04/2020-Green card arrived w/ no interview (USCIS did not update online status)

Each sponsor indeed needs to make enough to cover the support.

 

If you yourself are the sole supporter, then it is for 2 people. If your dad is a co-sponsor, then he would have to cover for 3 people, himself and you two.

 

Did you supply pay stubs and letter from employer to state your new job and earnings? That could help to show them you are above the 125% line since previously as you said you were below the required amount.

I make enough to cover 2, and my dad makes enough to cover 3. I do have paystubs and an employer letter. My question is though, since I make enough for 2, do I even need a joint sponsor? We are just confused about household size because we live with my mom and she claims me as a dependent.

Technically you don't need a joint sponsor since you are now making above the requirement. Some would suggest having one available(which you do) and even just supplying it with the packet to avoid any potential issues later with it; but again you should be fine if you supplied all the documentation you could.

Thank you. So you don't think it would be an issue to submit my old tax returns with only the part time work listed? I only went full time in December, and I have the pay stubs from then and an employer letter. I just am not sure if that's enough proof that I make the money.
