Timeline

Looks like our case is at ready status, so we are getting close to interview stage!

 

On the petition, I included my fiancé's 19 year old son. He turns 20 in April. Seeing that he is eligible to sit in on the interview, I am inquiring about whether we should attempt for K - 2 Visa or not.

 

He is attending college, and would have to follow-to-join a couple months later (June) during his school break and after our marriage (May), but only very briefly, because he would return to India to finish his schooling...so he wouldn't necessarily be looking to permanent reside in the US until he is 21 years...after he graduates. Does that pretty much lock things up regarding a K-2 hopeful?

 

I read that getting an AOS for him is only doable if my fiancé and I married and I established a stepfather relationship prior to his turning 18 (does that mean he would have to apply for a Green Card himself, then?). I hear conflicting info, but I was wondering if his immediately needing to return to India on some form of Advance Parole is just worth it to even bother for a k-2.

Sounds like best option is to get your fiancé here and when she gets her GC she can apply for him right away that might be right with the timeline for his school.

Do you mean that I shouldn't bother with a k-2 and just get my fiancé's GC...and then apply for him without trying to rush him in and out?

Well you can't rush him in and out from you send in his papers at least 90 days will pass before he gets the AP which he will have to have to get back in to the country and he will also have to be present if you guys get an interview. And he will have to seek permission to be out of the country for a longer time while he studies.
