I-134 question about children

I have a question about I-134 Form. My Fiancè (petitioner) have children, they are all adult except one, she is 14. She lives with her mother in the other corner of the States. He is not having child support duty for her, her mother never wanted him to pay no child support, but he is taking care of her, calling her and sending some money or presents, but it is not "on the paper". With other children he had to pay child support which he is still paying but they are grown now. Which of them should he include in the Form, if none of them is really fully dependent on him?

05/24/2018- EAD approved (expedited on 05/04)

06/01/2018- EAD delivered to me

07/30/2018- AP approved

08/01/2018- AP approval notice received in the mail

I'm not 100%, but he may have to include the adult children he's still paying child support too as he is still supporting them.

But yes, the child absolutely has to be counted. Any child under 18, regardless if they live with them or receive money from them on paper or not gets counted. I'd be more worried about the adult children that still receive support from him.

I have some more questions about I-134 Form and decided that I wont make another thread, since I created this one not long ago, but I cant change the title, sorry for that. Since the Form changed lately and instructions are not quite clear for me, can I ask someone who already passed it to make an example Form for me? And send it even by private message? Example on the vj website is old. I know its a lot to ask, but I got so many questions that I don't know where to start. Like, for example instructions say to write "none" or "n/a" if question do not apply, but what about the address? It ask if the mailing adress is the same as physical and than im typing yes and than I still need to put "none" on the physical? Or just leave it blank? Or later they say if the sponsor is not born in us to mark the answer but what if he is? Just leave everything blank? And should the sponsor fill question 12? And in the end, if we do not use no interpreter or attorney we should still attach pages 6-8 and put everywhere n/a? This is so confusing!

Just as a note, it's the USC that should be filling out the I-134.

But it's not as overly complicated as it looks. If the mailing address is the same as the physical, then when you check the box saying it's the same as physical you just leave the mailing address section blank, it's not a case of considering it not applicable because you would have just answered that your mailing address is the same as the physical address. It even says you only put the physical address if you check NO for the mailing address and the physical address being the same.

Overall, if it's something you CAN answer, you answer it. If it's something that doesn't apply to you, if the entire section doesn't apply to you or says to only answer IF you meet a certain criteria, then just leave it blank.

Ideally you want to leave as little blank as possible, but they won't kill you if you leave something blank unless it's say your address, or employer information. If you leave say the province section on the address blank, they won't come after you or anything like that as long as your address is correct.



If the sponsor is born in the US then you leave sections 11.a-12 blank.



Also note that if you need more space filling out the info for his adult children (you would put them as he's partially supporting them with child support), you can do that on part 7 or you can attach a separate sheet with all the info written and put "see attached page".

and I don't think we would put his adult children, because what he is paying now is not current child support but what he owe, he is not supportimg them at the moment.

You can leave the pages about interpreter and translator blank for sure.


Someone might chime in, but if the children are receiving money from him, even if it's back child support, then he's technically partially supporting them BECAUSE he's paying back child support. The fact that he has to give up a certain amount of money to each kid each month implies that he's partially supporting them as it's something that he knows is going to come out of his check and it's something to aid them either because he didn't pay it, fell behind, or the state laws allow child support to go past 18 (some states do).

It'd be much like paying alimony for a spouse, the spouse isn't their dependent, but they are partially supporting them by paying alimony.


Hopefully someone else  comes in and clarifies it, but ideally if there's someone that he's financially committed to giving money too, it's counted as partially supporting.
