K2 Follow To Join

Hi all, I just need some help about my son (K2 Visa follow to join). we just file his AOS packet last week, and today we got the RFE. below is the statement of the RFE

 

Based on the information you provided, your priority date could not be established. Please resubmit your application with the proper documentation to the address listed on the bottom of this notice.

 

The ff. documents may be provided:

* Your original Form I-130, (Petition for Alien Relative) if you are filling concurrently; or

* Your original Form I-140, (Immigrant Petition for Alien Worker) if you are filling concurrently; or

* Your original Form I-360, (Petition for Amerasian, Widow(er), or Special Immigrant) if you are filling concurrently; or

* A copy for your form I-797, (NOA) if the I-130, I-140, I-360, or I-526 petition has already been Filed/approved; or 

* Other evidence that an immigrant visa petition has been filed/approved on your behalf.

The need a copy of the approved I-129F as I see it they can't figure out what visa he is adjusting from.

Alright we're just going to include all NOA's we had from the I-129F up until the AOS approved?? Do i need to fill out the I-130?

Hmm I'm actually getting confused now (to tired lol) .... How long has the K-2 been in the country?

he came here June 2016 and we didn't get a chance to file his aos. We just now file his AOS this month

Okay I-130 is not for K-1's and K-2's so no that should not be needed

 

What did you put in his AOS package?

I include the I-485, I-131, I-765, I-864, and as a supporting documents i include my green card, social security card, state ID, our marriage certificate, the copy of our lease, and i did exactly the same thing what i have submitted on my own packet. So i'm not quite sure what i miss???

Okay looks like the copy of NOA2 from the I-129F is missing. That have to be there also.

That's the thing i didn't include that its my bad  i didn't know  alright, so do i need to file the form I-130?? or not??? or all i need to include are all of my NOA's copy???? from the I-129F up until my AOS?

Also remember to attach his I-94 so they can see he was admitted as a K-2.

You also need to include a copy of NOA of your I 129F approval (I actually included NOA1 and NOA2 for my kids), you can also include a copy of the US Embassy manila letter with his name on it and MNL case number. Include a cover letter on your response explaining that he was your derivative/ K2 on your I 129F petition and cite other documents that you can attached that will link his name/ MNL case number to yours.

hi, Thank you, i will include all of my NOA's now. I did submit all the letters from the embassy too
