Adjustment Of Status / Work Timeframe

Hi! 

My fiancé and I are trying to choose between the K1 visa or the CR1 visa in terms of Adjustment of Status and Employment Authorization Document timeframe. Which visa would be a better choice if we want a faster AOS and EAD?

Cr1 you enter with ability to obtain work auth.  K1 is shorter in le gtg, but at least 90 days to obtain work  auth after you apply for aos

If you want to estimate the time frame, you should consider form the actual start of petition.

 

CR1-  you need to be married to do this, after marriage (it takes 3 months or so to get all official docs from PSA)  you file for CR1 and approval/ processing to US POE could be at least 1 year. SSN/ GC are already processed along with the CR1 visa. 

K1- processing timeline can be around 6 months to 1 year depending on results of medical in the Philippines. You also should have met in person at least once in the past 2 years. Faster to get a K1 visa, EAD can be 2-3 month filing AOS with EAD/ AP, AOS to get GC can be 6months or longer depending on your local field office processing timelines. 

 

So if you wanted your fiancee to be in the US faster, take the K1 route. If you will ask me, K1 route is still faster.
