hello friends. My cousin married an american citizen and came here to the country. The husband is verbally abusive and opressive towards her. she is stuck in a rut, she can't even leave him because she still has not received her permanant green card. she is just wanting to leave the country all together.. but I don't want her to do that because she is still attending college.. and she has no family back in the homecountry. she does want to have her marriage work but her husband is holding that green card over her to dominate her. is there a way for her to recieve the permanant card without his help. I mean if they do separate does she have to leave the country for good. please help. I am desperate for her. thanks.

P.S- this world is full of crazy lunatics...so if u have found true love- please do cherish and value it.

At what stage is she in securing permanent residency? Have they filed to adjust status? Do you know what ype of visa she used to enter the country? Does she have any evidence or reports with local authorities of the abusive manner in which her husband treats her?

She came to the country with the I-130 petition. She is still 5 months away from filing the renewal for her permanant green card. there is no proof of the abuse.. because it is mostly mental torture.

Then if she already has a conditional green card, and evidence in her possession that the marriage is/was bonafide, and separation or divorce is looming before her, there should be no immigration issue that could preclude terminating the marriage. In otherwords, with a conditional green card already, she can divorce and self-petition in 5 months (as long as she has the evidence of commingled financial obligations and shared residence).
