Hello,

 

I'm in the process for my K1 Visa for my alien fiancée. I have submitted my I129F and is currently with CSC, I'm just waiting for my approval. I'm a little confused about applying for I765 Employment Authorization and apply for Social Security Numbers after K1 approval.

 

I'm not sure which step to do first, should I get him a social immediately after his arrival in the USA then later apply for I765? From what I have researched, he is entitled to a social security number as soon as he gets to the USA and wait at least 14 days to apply for a social security number. We have 90 days to apply for a number then after that we may extend his work permit, but if I apply for a social security number first it will say NOT FOR WORK something like that. I want to get a social for him to add him on my bank account, apartment lease, utility bills and to register him to get his GED at a community college. He also wants the privilege to work and help with fiancés.

 

If I apply for I765 first and leave the field blank where it states to list his social, will he get issued one after approval? I read on USCIS website that I can submit a I765 with my I485 to save on fees but that would be after we get married. To apply for a social I have to apply soon once he gets to USA otherwise he will have to wait until he gets his visa.

Once your K-1 is issued and you successfully enter the US, you can apply for a Social Security Card. You will not be eligible to work yet. You need to obtain an EAD first. Technically, you can apply for this prior to your marriage, but it will only be valid until the end of your K-1 visa (90 days after entry). And EAD takes ~90 days to be issued. See the problem? =.= In other words, don't waste your money or time with getting an EAD before marriage. Just file for EAD (and AP) after marriage in the AOS packet. Once issued your EAD, then you can begin working.
