What comes after 1 year ban For admitting drug use is up

I did and I have been told a different story everyday for 3 weeks. He landed in Jaurez today. His appointment for new physical is tomorrow. We were told for weeks by USCIS that they had submitted a request for an information letter and it would take 10 days. If not approved I could submit it for a second time. SOOOOO I had to do this twice to only be told a few days ago that we would not get any response until the new physical had been submitted. They said we did not have to submit anything with it or got to any other appointments. All he needed to do was go too the new physical send it in and they would send us an information letter after then. Has anyone else been had a similar situation please shed some light. I am still confused and not sure cause everyone else with similar cases is saying different things. Like the information letter comes first, asking for permission to resubmit new physical, fyi he has the letter that says to return after March 2017 for a new physical, also things like do we mail in with passport or any other form new or updated. Thank for any help.

a 1 year ban? wow...happy for you that it is up soon!! Did he just admit it in conversation or did the medical exam include a drug test?

KozmicBlues, I am sure they drug test everyone, in what way i am not sure. He only admitted he did not test positive. Its was a one year ban for admitting and 10 year ban if you are caught or suspected lying. Thanks just wish we could get some solid answers. Most people up here complete there cases and never check back in.

Hi,

 

In the medical exam, they ask you various questions on a form. If you admit to having done drugs than they will escort you to psych. The psychologist will ask, and if you tell the truth you're only given a one year van. If the psych decides you lie, the ban is significantly longer.

 

They also drug test everyone. In this case, I am not sure what the punishment is if they do find something.

Make sure your page is updated so you can print receipt otherwise you have to wait a few days. Also We were told are waiver was over a year old even though the one year mark is today, we were told we could not redo anything before March 2017 and that we only needed updated Physical. Hubs goes today to consular and now they are telling him we need a new waiver and that will take about 4 to 6 months. So I pay and book him another flight home in Mexico after we paid for physical again. To be told that we know nee to pay and update his waiver and wait 4 to 6 months. My question it what will they say next time. I wont know cause we have exhausted all funds. I guess we just have to give up and give in to this broken system for now.

It is really unfortunate that you had to go through that. Do not give up though, if it takes you hiring a lawyer you definitely should. 

My fiancé had his interview April 11th. They only asked him for his medical exam-- and that was it. They also made sure he didn't have more than a year since his last interview- or else he would have to pay. Since it wasn't our case, he was given the visa since he passed his med exam.

They told us we needed to apply for a new waiver i-601 he has already been gone a year. No criminal record. Why do we have to re do waiver. Will we have to wait another year?

@NancyArellano Hi Nancy, congratulations on your husband visa approved! I've been following your case since is very similar to mine. My husband was denied his green car and was given a 1 year ban for admitting marijuana use. His interview was April 7th 2016. We were told to contact them after April 2016. We called on April 8th thinking that after this day his case will be reopen but they told us to call back on May 2017. We called this week and they said there is no news and that they will send a report to the consulate. I am assuming this is to re-open the case? Is this normal? Also it will be more than a year since his last interview so I assumed he will have to go to both physical and interview. We have all the paperwork, new police letters, monthly drug tests ( our lawyer recommended us we did this to demostrare remision). I guess no we just keep waiting.. :( ?? any words of encouragement will be appreciate. Thanks!

greyson.rizo , did you have to apply for 601 how long has it been ?

Right now im waiting for counsular to approve me this letter so i can have another 2nd interview , did my medical exam ,my ban is up and just waiting for date for 2nd interview

Yes we applied for new waiver already in April. Once your ban is up, you can make a new appointment for interview and medical but you will not able to go home with visa yet. You will have to apply for a new waiver this time a I601 not I601a cause you are not in US. Right now they are working on cases from July of last year. So you are possibly looking at possibly another year. Make sure you get enough evidence and good letters to prove hardship so that when your time comes back they don't return for evidence. Good luck at your second interview!

Yeh thats what i heard from lawyer that is 601 not 601a. I still dont understand why my 2nd interview date isbtaking  long . What the heck another year is what im hearing too this is bull ####### i cant believe we have to wait more . Yeh we are gathering all the info i can and hardship  letters and etc we are 95%  ready with the 601 when im just waiting for interview date but dont know why is taking long ..... how lond did it take for you to get interview date?

I know we were very upset about this too, but there is nothing else you can do. If your lawyer is telling you this, make your own appointment. To do it online you will need to call and ask them to open it up so you can make a new appointment. If not you can call and make one over the phone Make sure you take that original blue or green form you got at last interview to new physical and go back to the same place you went to last time and be prepared to pay and do everything again and more than likely you will be waiting another year and have to pay do everything for a final 3rd time. I know already BS!!! I think me and you had talked in past on a different post and i was trying to explain this very same situation.
