AP because USC not present at legal wedding (split)

Just got my case on AP. I filed CR1, and my wife had her interview on 01Dec16. The case on CEAC still says ready.

They kept our original marriage certificat. They put it on AP cause I wasnt present on the Cilvil marriage, the senegalse legislation recognize the marriage. We also have our marriage religious certificate.

Will the case be return? Im thinking about filing for divorce and remarry again. That way I can file a new i130.

But in order to do that I have to withdraw the case first.

So you had a proxy wedding, where only the foreign beneficiary was present? Did you meet afterwards, and before filing? or a proxy wedding to count for the CR-1, you must consumate the marriage after.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
