K2 visa illegitimate Child fathers consent needed by US Consulate?

I'm sorry for that humps u guys going through.. but may i ask how old the kids? the reason i ask is because there is a family code allowing the illegitimate child to use fathers surname .as long the father will claim and will be the one to submit the public document. My son is 7 and he is carrying his biological father but i did not have any problems getting his passports.

We had no problem getting a passport for my fiances illegitimate child even he has fathers last name on birth certificate, I hope we don't have a similar problem as her interview is the 13th

You won't, the child has the passport... all is good .

Their case is unique for lack of a better word. Most have no issue with the father's name being on the BC to get the passport.. and I know of hundreds where the father's name was used on the BC

Thanks for this.  One of my fiance's children has surname of father but they were never married.  So if I understand things correctly, 

as long as father's signature is on birth certificate, we are good to go.  If not then the birth certificate needs to be corrected.  The question

is how can they allow father's surname on birth certificate if he doesn't acknowledge by signing to begin with?
