Second K1 formally withdrawn

Aloha,

In 2008, I was married to a lovely soul from the Philippines. Unfortunately things

did not work out and in 2012 she and I were divorced.

In 2015, I petitioned for another filipina. The petition made it all the way to the

embassy in Manila. It was only then I discovered she had created ad's on two

sites offering her sexual services in exchange for someone to put her thru

Med. school (she hooked up once). Needless to say, I was crushed and things

came to an immediate halt.

I began a frustrating (but successful) effort to have the embassy formally withdraw

the petition. They eventually sent me an official form confirming the withdrawal.

I did this for two reasons - 1. to open our slot for another couple and 2. if ever

I decided to K1 again, I thought a formal withdrawal would look better than

letting the petition languish in a slow death.

In the present, I am considering another K1. I am concerned that on our NOA2

(I believe - I'm too lazy to dig it out) it stated I was on some type 'watch list' due

to submitting two K1's within a 10 year span I think.

I have the withdrawal confirmation. I also have screen shots of her two ad's.

If I include these, along with a detailed chronology of what happened, will

there be problems with this K1?

You can petition for a 3rd K1, but you will need a waiver- this is for anyone who has filed for 2 or more K1s, even if the visa was not approved. The waiver is basically a letter you file with your petition, explaining the situation of the previous two petitions and why those relationships ended so yes, include the withdrawal letters and other evidence of the 2nd K1, and the divorce decree of the 1st K1.

Yes, same person. She was diagnosed with ovarian cancer and that put a stop to

things for awhile, Her health is now improving and we are beginning to talk about

this again.

Dig it out, I have never heard of this before. I seriously doubt it was on a NOA2.

A detailed chronology, narrating everything, will definitely help. Don't ramble in it but make it short and clear.

Sounds like you had valid reasons, include some evidence in support of the letter.

Attach all I-797 and withdrawal letters.
