Hello everyone! I have been watching this site for the past two years of our visa journey, but this will be my first post. My Fiance and I are working on getting a k-1 Fiance Visa. He currently lives in England. We made it all the way through the interview stage, where we were told we needed to file an 1-212 waiver. We were aware of this, and were assured by the immigration office on site that it was very likely to be approved based on our case. The problem is that My Fiance's medical exam is going to expire before the 212 waiver is approved. It is my understanding that once the medical exam expires, the visa becomes invalid. In our case, his visa will not have even been issued before the medical expires. Unfortunately, my fiance works at sea, and cannot get a new medical before the current one expires. I have tried calling the USCIS help center, and they were unable to answer my questions. My lawyer is equally uniformed. Has anyone been through this before? Can anyone tell me what to expect from this, and what steps we will need to take in order to clear this all up? Also, any idea of how much additional time this will all take? At this point I am not sure if we will need to resubmit the i-129, redo the interview, or just redo medical and wait for paperwork to process. Thank you for any help that you can offer!
