Hello, and thank you for reading. I wasn't sure where to file this, so I figured it best to start a new topic.

I am working on getting a B2 visa for a Thai citizen. I have known her for about 5 years, and we have no intention on getting married, hence the tourist visa. The issue is, I have read so many things stating how difficult obtaining a B2 can be.

She is from a poor family, and rents an apartment for herself and a house for her mother and brother; she does not own property however. Funds are not necessarily an issue, as it is someone I trust and can send her money if need be, so she has money in her account as proof of funds.

She insists it is necessary to 1) hire an agency and 2) receive a letter of invitation from me, as a "sponsor."

Reading up on it, the only sponsor letter requirement I've found is for a k-1 visa. Can it be used for a tourist visa as well? I am also worried that, me being Male and her being female, the visa would be automatically declined if there was any mention of me.

My second point of concern is hiring an agency. Do they really help? It seems like a waste of money for something like this, as they cannot guarantee anything.

If anyone has any advice on how to proceed, I will be eternally grateful. This is something that is very important to me, and has been bugging me for awhile.

The presumption in the law is that every visitor visa applicant is an intending immigrant. Therefore, applicants for visitor visas must overcome this presumption by demonstrating that:

  • ball.gif The purpose of their trip is to enter the U.S. for business, pleasure, or medical treatment;
  • ball.gif That they plan to remain for a specific, limited period;
  • ball.gif Evidence of funds to cover expenses in the United States;
  • ball.gif Evidence of compelling social and economic ties abroad; and
  • ball.gif That they have a residence outside the U.S. as well as other binding ties that will insure their return abroad at the end of the visit.

A letter of invitation is meaningless, the CO does not have to look at any document she presents during the interview.

She has to convince the CO during the interview that she has strong ties to return home, sufficient funds to cover her expenses for travel.

You sending her money to prop up her bank account is very suspicious/fraudulent and a well-known trick.

All she can do is to fill up the Nonimmigrant Visa Electronic Application (DS-160) Form online for the Tourist visa and pay USD$160.

Most of the time, the information on DS-160 are sufficient for the CO to make the decision

No agency or attorney required..its a very simple process to fill out a form online.

There is no 'sponsor' so a letter is pointless, she needs to convince them at the interview that she will return to Thailand after her trip by showing strong ties.

She should be honest in her answers but no need to volunteer any information unless asked.

I would imagine most people on here would consider from the milited you have shared that she is not an obvious comment.

Other countries have different requirements so not surprising that the requirements for a visa get confused.
