I-130 and B/2 Tourist visa help

Now that I've become a us citizen :) I am going to file for my parents. They are from Colombia and currently have tourist visa that were just renewed last year. They have been visa holders since 92. They have never overstayed their visa. But now as they are getting older and all of the other immediate family has immigrated here I made the decision to try and ask for them.

So my question is:will there be any issue filing I-130 if they are current visa holders! Would they still be able to travel to the USA while awaiting their case to be process. ( they are suppose to come for Christmas). Would this be considered fraud if they are traveling on their tourist visa but have filed I-130 so that they can immigrate. My father is very worried their visa would get taken away. Also I'm not even sure how to start this journey. Should I seek an lawyer or would this able someone I could do on my on.

Perfectly fine to visit with a pending immigration case. I visited my husband twice during the wait for our I-130 to be approved. I did have a bit more scrutiny at the border but I was prepared for that.

They must bring evidence of strong ties to their homeland to satisfy the CBP officer that they are doing things correctly and will return home after their visit to await their embassy interviews for their IR-5 visas.

Obviously a B2 (or any other visa) is no guarantee of admittance. Everything is at the discretion of th CBP officer at the airport. But with return tickets, proof of ties to home, etc they stand a good chance. Particularly as their travel history is good.

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
