My spouse (foreign) and I (US citizen) got married about one month ago and we plan to begin our CR-1 application. I'm concerned about the "evidence of a bonafide marriage" section because we have only lived together for about one month. I won't bore you with the details but for a lot of complicated reasons, work being the main one, we are not residing in the same city and while I plan to be here in his home country for the next few months, we may not be able to live together. We don't have a joint bank account and neither of us own any property. I'm afraid they will deny us thinking it isn't a bonafide marriage based on our not living together. Any suggestions?

Open up joint bank account ?

USC can apply for Tax Identification Number for Non Resident Alian from IRS and file tax return as married filing separate ?

Use that Tax identification Number to add spouse to your US bank account as joint bank account ?

Lot of Pic of you two including wedding and reception wedding invitation ring ?

Wedding party hall recept with wedding invitation same day ?

Affidavit letter from friends and family member about relationship and wedding ? 2 family members and 2 friends

Also a travel pic

Boarding pass visiting spouse

Phone call logs

Chat logs

Want to Speed up NVC Process ?


Check Guides From Guide section for doccuments and list of stuff and follow this steps


Step 1 After USCIS NOA2 Gather all AOS / IV Package Documents In 3 weeks


Between USCIS Approving and NVC Case Number you have 2 to 3 weeks gather all AOS and IV Documents Get package ready.


Step 2 Obtain NVC Invoice and Case number.


​After 2 weeks of NOA2 Keep on Calling NVC every day to get case number And Invoice number


Step 3 Pay First Fee and DS261


After getting NVC Case Number and Invoice Number Log in to webpage Pay First Fee and Fill out DS261 Takes 24 to 38 Hr to get fee status paid.


Step 4 Conform Agent / Ds261 Over Phone and Sent out Documents


Once First fee turns Paid Online ( Usualy 24 to 48 hr) Call NVC And conform choice of agent over Phone If they won't keep on calling them Until someone will Or other fee won't be unlocked.Also Once you get Welcome letter on email Print out Document Checklist sheet And Sent in your documents to NVC


Step 5 Pay Other Fee and Fill out DS260 (Total time from DS 261 to here should be no longer then 15 days )


​Step 6 Conform Document delivery AT NVC And Ask them Processing Time..


Step 7 Check For CC ( Hopefully no REF )


Call them every other day 2 weeks from DS260 and Check status.. Also Check Online NVC Page If you have 3 N/A your case Complete! Congratulation you are almost done.


Step 8 48 Hr After CC Conformation Call NVC For appointment for interview


Congratulation On your NVC CC AND Good Luck with Interview

Time spent together is what they are looking for. I assume that after work or on your days off you spend time together? Do you go to hotels? If so, send the receipts. Have you met his family? Pictures of you with his family at family events such as birthdays and so on are good - shows you are part of the family.

Time spent together is what they are looking for. I assume that after work or on your days off you spend time together? Do you go to hotels? If so, send the receipts. Have you met his family? Pictures of you with his family at family events such as birthdays and so on are good - shows you are part of the family.

We have spent time together. I have plenty of photographs of that and boarding passes. However, we had such kind of evidence for our fiancé visa which was denied as "not being a bona fide relationship" so I'm worried that this isn't concrete enough. We had lots of photographs together as well as chat and Skype phone call logs. I have more of that and also marriage photographs. His parents live in a very distant rural area and I have not been there to visit.

We have lots of evidence of time spent together (boarding passes, hotel receipts, photographs, chat logs etc) but we had that for our fiancé visa application and they still denied us saying "not a bona fide relationship." We do have wedding photographs now. I may try to open up a joint bank account here in Ethiopia since I'm here for the next 6 months. I guess I'm concerned given our denial for the K-1 despite having had lots of photographs, chat logs and travel receipts.

Many people can't live together after their marriage just because they live and work in different countries until the moment the beneficiary actually receives the spouse visa. If you plan to go to his home country, you will definitely rent a place. Why did you say you would not live together? If you are going to live in his home country for the next several months but not with him. This is what will raise a red flag.

flight tickets would be good too, put him on your insurance, or whatever you can put him on. Did you send him money? Like western union or any other way. Put him on your bank account as someone stated earlier.

Yes open up bank account there as well as US when you get there.

Also don't forget about Relationship Statment / Afidavit Statment from family and friends motorized and certified that will definitely make difference.

Yes. I am in his home country and we are unable to live together more than a month due to work obligations. We will be in different cities for the next several months. This is my concern.
