CR1 or/and K3

Hi:)

I just have a question. I heard the CR1 is the immigration visa and the K3 nonimmigration. Is that right?

Once you have the CR1 you are allowed to stay in the US for 2 years and get the Adjust of state (or something like that)....so what sense makes the K3 visa? If I wanna stay with my husband over there ...do I need both or just one? How long does it take to receive eighter K3 or CR1? He is gonna apply for me in Maryland, any experiences about that area?

02/28/06...NOA1....I-130 VSC

May 2006..Medical in Frankfurt

06/14/06...I-130 approved via email [day 111]

06/19/06...NOA2....I-130 received via mail

07/10/06...talked to embassy to expedite the process

07/12/06...NVC stated case completed and sent to FRANKFURT[day 147]

07/17/06...received packet 3 from embassy

07/29/06...received packet 4

08/15/06...INTERVIEW at 7:30am- APPROVED

08/21/06...VISA received

08/23/06...Flight to US

08/23/06...I am back home

09/20/06...received greencard in mail

09/27/06...received SSC in Mail

09/23/07...our daughter was born :)

30/05/07...filed for Removal of Conditions

07/05/08...received NOA for I-751

01/07/08...college here I come :)

waiting for biometrics and Approval.....

so what sense makes the K3 visa?

Everybody's case is different, but for example, I have to file thru California and they are waaaaaay backlogged for CR-1. By doing K3 I get to also file in Chicago and they are not so far behind. For me it may make a difference of getting to live with my husband sooner. (by possibly 4-5 months based on how far behind Cali is)

If I was filing in Vermont (fast) it might not make that much of a difference as the CR-1 could get to the embassy faster. I was willing to pay for the extra petition so that I could *possibly* get to be with my husband sooner.

Started our visa journey Jan 06.

01-06 - I-130, K3 shortly after

04-06 - switched to Canada Immigration

07-06 - Moved to Canada (PR almost complete)

07-06 - Changed again, back to US imm.

09-06 - Landed as Canadian PR

10-06 - DCF Toronto, Approved in 1.5 hrs!

11-06 - Interview Montreal (success!)

I-130

10-05-06 DCF in Toronto - Approved

10-19-06 Packet 3 received & sent back

10-20-06 Montreal receives P3

11-03-06 Packet 4 received

11-06-06 Medical

11-22-06 Interview / Visa approved

11-26-06 heading home, 6 day drive, my oh my

HOME SWEET HOME

10.24.08 - Mailed I-751 to CSC

Delivered at 9:03 AM on October 25, 2008

10.29.08 NOA1

10.30.08 Check cashed

12.06.08 Biometrics Appt.

12.19.08 Received new Drivers License extended to 2011

03.12.09 Received CONGRATULATIONS letter - Card on the way!!

03.20.09 Received his SHINY new card. WOO HOOOOOOO

YAY!! We can take a break from this madness until Citizenship.

Thanks very much for responding that fast, I will read the guide....Im just so busy with this whole site :s. So if I apply for the CR1 as well and it takes longer I will be able to join my husband sooner if I got the K3 visa. I see.

FYI, in order to get file the I-129F for the K-3 visa you must first file the I-130 for the CR1.

Isabel,

You seem to have a fundamental misunderstanding of the two visas.

With a CR1 (or IR1) visa, one become a LPR on entry and does not adjust status (nothing to adjust).

With a K3 visa, one is allowed to stay in the USA for 2 years during which time they must either adjust status from non-immigrant to LPR or, at the appropriate time, go to the appropriate consulate to interview for a CR1 or IR1 visa.
