USC Passport expired

Hi all, a quick question pls.

My fiancé (USC) passport has expired in April 2016, and i saw in the guides that they required at least 5 years valid passport.

- Is it a problem if he includes that anyway?

-He has his birth certificate too, which states somewhere that it is illegal to copy or reproduce that birth certificate.

What would be the best option then?

Yes he was born in the US. ok for the birth certificate, but since he is including his Gabon visa, airports stamps, can he still include his passport copies like the 1st pages as evidences we have met ? or he should totally exclude passport copies?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
