Hello everyone

I am a US Citizen living in the US, filed I-130 forms for my wife and 2 years old son who are overseas, (my daughter was born several months after I submitted the I-130s and before I get the approvals of my wife and son).

My wife's and my son's I-130s' got approved and now preparing the affidavit of support part.

My income is not enough so I am using a joint sponsor (married filing jointly with 2 kids)

Which I-864 forms does each of us need to fill out? I need to make sure I am using the right forms.

My understanding is:

I file form I-864 for my wife, form I-864W for my son.

My joint sponsor files form I-864 and form I-864A for his wife, since he will be using her income.

How do I break up their individual income in the income section when they filed jointly?

What do I need to do regarding my new born daughter?

How do I add her to the process?

Do I need to fill out form I-864W for her, as well?

hi

your daughter probably is already a USC, you have to file CRBA, and what about your son, why are you filing for him

doesn't he apply for CRBA, as an automatic US Citizen?

Hi

I knew that I could have filed CRBA for my son but was too late, after I filed I-130 for him and got approved

but are these the right forms to file?

I file form I-864 for my wife, form I-864W for my son.

Why were you to late to file CRBA for your son? Is he over 18 years old?

He cannot receive a visa if he's a USC, the I-130 should have been denied if he's a USC.

hi

it doesn't matter if the i130 was approved, if he is a USC, he will be denied a GC at the interview, he can't be both

if he qualifies for a CRBA, then you must file for both of them and get their US passports as both your children are USC

^^^^^^100% this.

Assuming of course that you meet the physical presence in the US requirements in order to transmit citizenship.

(5 years in the US before the child(ren)'s birth, 2 of which has to be after your 14th birthday.)

File for CRBA & passports for both of them.

If they are USCs then they cannot get visas.
