Sorry wasn't sure how to title this but need some advice.

We were naive and didn't look into this long drawn out process but to cut a long story short these are the facts:

Filed I-130 in the USA

Received RFE for passport photos

Still waiting review

My maternity leave will be ending shortly so I will have to return to work as I don't want to resign if we haven't been approved. However my husband wants to return to look after the kids while we wait and go through NVC and interview etc.

Will this be a problem because he filed in the USA?

May 5 - I-130 Received

June 17 - RFE Received

August 4 - NOA2
October 3 - USICIS sent to NVC
October 12 - NVC received (69 days in limbo)
? - case number assigned
? - AOS bill paid
? - call NVC to review DS-261 and get IV invoice unlocked
? - IV bill paid
? - submit DS-260
? - send IV/AOS package
? - scan date

? - cc

? - interview date

Your husband is the US citizen, and wants to live in Australia till you are approved?

Assuming Australia allows him to stay- remember you may well still have 6+ months wait till interview- that is fine. The onl issue would be the financial affadavit of support; does he have assets or a co-sponsor, since he won't be working in the USA?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes he is a permanent resident of Australia, he only left in April to get a job in the USA and to start this process - we didn't know we could have done it from Australia.

I have been the primary worker in Australia and I believe we have enough assets to cover?

It depends on the embassy but yes, most prefer them to be in the USA, as they can seize them easier, should your foreign beneficiary become a public charge.
