If the OP understands that there may or may not be a problem with the burden of proof at his gal's adjustment interview, then he's got the information he needs to make an informed decision.

There is of course a bit more to it than that. The OP & girlfriend should not operate under the impression that she may show up here with all of her worldly possessions and a B visa (not saying that you said that, TD).

Many people prefer the K or other immigrant option so that they may move 'properly', because going back home to pick up your winter clothes (or whatever) may not be practical or desirable.

Clearly, the girl shouldn't travel with 8 pieces of luggage and a large garment bag marked "WEDDING GOWN - HANDLE WITH CARE." But since she's just coming to visit and not to get married, she wouldn't be traveling with so much stuff anyway.

But the OP asked about marrying on a visitors visa, not JUST visiting!!!!

The big question is:

Would she be able to come over here for the 3rd time within the next few months using her tourist visa to get married and to stay here without going back to wait for the spousal Visa?

Well, the girl will be quitting her 2 jobs and withdrawing her pension funds, etc... :( And no, she will definitely no more than 3 pieces of luggage because thankfully she does not have / need most of the stuff ;)

Well, she has a visitor visa. All he did was ask question.

I'm giving him the benefit of the doubt and and assuming, now that we've explained things, that she's coming to visit.

If they get swept up in the moment and wake up in Vegas hitched, that's a different matter altogether. If it can happen to Britney, it can happen to anyone.

If those are her circumstances, she does not qualify for entry to the US as a visitor.

You are playing a stupid game, and I'm not going to play it with you. Threads like this have brought down message boards and websites in the past.

You are clearly planning for her to immigrate on a non-immigrant option. If she is taking the actions you describe, she is planning it too. Please see the disclaimer at the bottom of every VJ page and understand that many of us take it seriously.

You have a palatable, fast. legal option in front of you. I recommend that you use it.

And now he's talking about her quitting her job, that is INTENT.

I would HARDLY say Britney (who is a USC) & her ex-hubby (who ALSO WAS A USC) is the same thing. Stop comparing them.

As Meauxna has said, this is a slippery (illegal) slope. I'm done with this thread.

You know, it partly situations like this one "come over on a visitor's visa, marry and file for AOS" that really upset me and make the long times we K1-ers have to wait for approval that much harder to take!!!! :angry: Circumventing the system is not a legal or palatable option! This forum is for general discussion on the K-1 fiancee visa.

Why do people come here w/ the guise of looking at visa 'options' and ask "Can my fiancee come here on a tourist visa and we get married?" If that is a question you want to ask, post it on either AOS, Off Topic or even the Regional Discussion Board for your area, but not in the K-1 foum. The rest of us, who are doing this the legal way and a hard enough time as it is, should not be burdened w/ having to advise someone else on how to/or not to screw the system.

In the long run those who do not do things the right way end up stigmatizing all immigrants, legal or not!

I'm sorry if that is harsh. Being a legal immigrant myself, who had to wait 2 years to emigrate here in States,I have no sympathy for those who want an instant fix just because they don't want to wait 6-9 months to get married.

:unsure: Huh? I don't understand what you're referring to. I went back and read through my post, and I wasn't directing any of it towards you. My general opinion was, and is, that if there is a legal option available, use it and don't spend time and effort trying to come up with an alternative that is not always legal or kosher. (What is with my food references in my vocabulary???....I swear I ate lunch today!) :blush:

Where are you filing from?

Will the documents go to California or Vermont?

i think the fiance visa is way faster than anything else and then adjusting her status here while she's on the tourist visa might be somewhat difficult or maybe more expensive?

I am in WI so I believe I would go through Vermont.

Would it really take 6-9 months for her to get the fiance visa? I thought I read 3-4 months somewhere around here.

it depends..mine took 7 months..my friend in cebu took 4 months, my friend in dipolog took 8 months and my friend in davao took 1 year...

had my immunization info transferred in I-693a thank God!

May 11, 2007-AOS mailed

May 13, 2007- item was delivered in CHICAGO IL

May 16, 2007- AOS/EAD NOA recieved

June 2, 2007- Biometrics Appointment Date

June 21,2007-AOS transferred to California Service Center

July 10, 2007-I-485 Card production Ordered

July 11, 2007-Notice mailed welcoming the new permanent resident.

July 13, 2007-Approval notice sent- I-485

July 19, 2007- Green Card Arrived! Wooohooo!

July 24, 2007- I passed my driving written test!

August 22, 2007 Passed my road test and started my work!

April 2009- Removing Conditions Applied

September 11 -got my 10 Year green card! yahooo!

December 2010- Apply for Citizenship
