Hey everyone!

I hope everyone is doing well on their journeys thus far. I just have a quick clarifying question for all of you awesome people.

Jon and I are planning to file in July for our K-1. He will be here to celebrate July 4th with my family( yes we find it funny that he is British and celebrating American Independence with us ;) ) and have a nice two week visit so we can fill out the forms and get all those signatures and passport photos done without having to send the paperwork back and forth through the mail.

My question is this, I don't plan on sending the packet until I review it about a zillion times after he goes back home, should I still fill out question 15? His I-94 will show that he could be here at the time I send the packet, even though I know he won't be. I have fallen victim to my own overthinking again and would just like some clarification. Every time I read the instructions it really seems to say only if they are currently in the US, I was just concerned because of the I-94 stating that he could be here that long even though we know he would have left long before the time expired on his I-94.

I am trying to prefill as much information as possible at this point and I just keep getting stuck on this question...

I'll give you my logical, not fact based, opinion on that question. I really think that is meaning if your fiancé is living in the US on another visa or immigrant status. i can't help but think it is not pointed at a bloke who is on a two week holiday and the petition might get mailed during that time. I can't figure out why that would matter during a short visit. It's an odd question.

I'll give you my logical, not fact based, opinion on that question. I really think that is meaning if your fiancé is living in the US on another visa or immigrant status. i can't help but think it is not pointed at a bloke who is on a two week holiday and the petition might get mailed during that time. I can't figure out why that would matter during a short visit. It's an odd question.

That is originally what I thought as well, that it would be for people who are applying for a K-1 while their SO is on a Student or Work visa, but then I wasn't sure since a lot of people just file for AOS in that case. I am glad to know I wasn't the only person thinking that, regardless of if it was correct or not.

Thanks again for your input! I will just leave that area blank since I won't be sending the petition in until after he has left.

Yep, same thoughts. If fiancé was here on a visa, then they don't really need a visa to get here in order to marry and stay. Never could get my head around the real purpose of that question.
