Hi all,

Please help with advise or info. I'm getting a little worried about this.

I had my Interview in Baltimore on March 8th Passed the test and all went well but the IO couldn't make a decision but gave me the n14 continuance letter asking for the following.

1, Tax account transcripts

2, List of all my travel for the past 3 yrs. (Applied on 3yr rule)

I ordered all the transcripts and included my travel info and had it delivered 10 days later. During the interview the IO knew that I had just returned from a trip abroad,I was suprised as to why she needed that info. She claimed she had all my travel info but could only give me my arrival dates, exit,I guess was on another computer that she could use if she wanted to. Interview lasted about 15-20min, no other issues.

They have now had my rfe response for almost 3 months. I've had an infopass and 2 tier 2 service requests already and all they keep saying is to wait. The infopass officer said my file had not been assigned to an IO yet, that was about a month ago. Has anybody had similar experience in Baltimore or any other office?

I filed based on 3yr marriage and there was no other issue at the interview other than missing passport and tax transcripts which I have sent to them. What is the best and cheapest way to get them to adjudicate?

When will they give me a response?

July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

If I understood your post correctly, your application was not approved because you did not present two pieces of information that all 3 year applicants are required to present. But you can't change that so its good that you responded to the RFE promptly.

She needed the passport because they have to verify all your travel as a permanent resident. I assume you had all your trips listed on the n400 form. If you didn't have your passport with you then that's one likely cause of the delay. Everyone is required to present their passport or proof that it was lost or stolen or otherwise unavailable.

The tax transcripts are also required as supporting documents to prove you and your spouse are in a legitimate relationship.

They have 120 days to make a decision after the interview. I don't know whether or not that time resets in the event of an RFE. Advice; when it's been 4 months since the interview date, make an infopass appointment and check on your status. If you want to call in the meantime, you can do that.

Once they review the travel info and the tax transcripts they'll decide on your eligibility. Good luck to you.

FYI; customs and border patrol definitely have your arrival dates in their database. Youll notice that in the U.S. you don't go through passport control when you're leaving the country like you do in some other countries. The airlines are required to keep records of all international departure information. I'm not sure where this is kept but based on a reading about a few other interviews over the past few years, it's clear that USCIS has access to this, but it isn't as readily available as the departure info. I assume that it all ends up with CBP.

You're right that it could possibly drag on, which is why I advise an infopass. The only reason I suggested waiting until the 120 days are over is that sometimes the person you meet during the info pass will take the easy route and will just tell you that you have to wait until the period is over rather than actually look into your case. However, you can certainly contact them now If your case has been set aside and forgotten, contacting them now may well get things moving.

He said he would send an e mail to the supervisor, that maybe that would help. Still nothing has happenned since then.

Well my advice is that you schedule another infopass appointment for when USCIS has exceeded the amount of time allotted to them to review your case. As I said I'm not sure if that is 120 days from the interview or 120 days from the receipt of the requested information.

Well my advice is that you schedule another infopass appointment for when USCIS has exceeded the amount of time allotted to them to review your case. As I said I'm not sure if that is 120 days from the interview or 120 days from the receipt of the requested information.

Thanks, I appreciate the advise. Hopefully I get a decision soon but I'll wait another few weeks till the deadline is past before I schedule a infopass appt. 3 months to take a look at certified tax returns seems a little much, but there're millions waiting.

The only thing worse than getting denied is not knowing anything at all. I think uscis know that too.lol...

it's been two weeks and I have not received anything.....

NO RFE, no updates, no mail.

I read cases where they take more than a year......

I know the have 120 days but just the feeling of not knowing....

If you didn't get a rfe you'll probably get your your oath letter soon.

My local office received my RFE in 06/06/2016.
My on-line status was update in 07/13/2016.
Therefore, my RFE took 37 days to be finished.


I know that waiting for answer is not exactly a good feeling, so I am leaving this message for everyone who is waiting....

Though we live in a fallen world where we experience pain and disappointment, the Lord can move us from despair to rejoicing, as we see in Isaiah’s prophecy about the coming of Jesus (Isa. 61:1-3).

The Lord gives us hope when we feel hopeless; He helps us to forgive when we think we can’t; He teaches us that our identity is in Him and not in what we do. He gives us courage to face an unknown future. When we wear the rags of “ashes,” He gently gives us a coat of praise.

God can bring times of growth out of our times of heartache.
