K1 Visa and Police Clearance

Hello everyone, hope your weekend is going good.

Question... My fiancee worked in Hong Kong for 5 years. Once we decided to meet she left her job in Hong Kong and went back home to the Philippines. Before leaving Hong Kong she got a police clearance from the Hong Kong police. But that was dated April of 2015. We have started the K1 process but she seems to think she needs a new police clearance from Hong Kong since the previous one is only good for 12 months. She has not been back to Hong Kong so I was assuming that the clearance is still good. She says she needs a new one. And apparently she cannot send off for a new one until she has the nvc letter in hand. That makes absolutely no sense to me. But I've been wrong so many times in life that just cause something dont make sense to me does not mean it's not right. She says she has spoken to many filipinas that when they went for their interview in Manila that they were denied for not having current police clearance even if they did not go back to the foreign country again. My concern is... I've read that some people never even received the nvc letter and that they just called for their number to set interview and medical. Also I read that to get the police clearance from Hong Kong it takes 3 to 6 months to have mailed to her. So even if we got approved and noa2 we would still be held up for another 3 to 6 months before we could even schedule her interview. I just dont believe this is the procedure... Could someone set me straight please? Thnx

You'd think the point of a police clearance is to make sure you don't have a criminal history so if you haven't been back to a country that possibility is eliminated so why should a clearance have an expiration date when you have exited the country after its issuance?

It sounds completely ridiculous but if other Filipino applicants told her that was the procedure then you'd just have to believe them.

Your fiancee should be fine, she has not been back to HK since leaving 5 years ago, so that police certificate she has should be acceptable.

You fiancee may be confusing foreign police certificate with the NBI (this should not be more than 6 months old.).

I would suggest you also ask this question in the Philippines forum as acquiring the HK police certificate is not uncommon there.
