I managed to get on my (now) husband's lease even before I had my K-1 visa. I helped him move from Georgia to California before my K-1 interview when I was over visiting him, and we found an apartment together. Because I had no credit score, they just asked that we pay a full months deposit. And that was that! They didn't care that I wasn't a US resident. The apartment we stay in is run by a big company, so everything is pretty official. I really don't think you'll have any problems at all

Hey, just to put your mind at ease here-- very often those rules are there mostly so that the landlord can kick you out or not renew your lease if they want to. Like, with problem tenants who aren't quite doing anything illegal, just annoying/disruptive, they have a lot of strict guidelines because someone's going to break them at some point. It's mostly so that Betty Two Bottles Of Wine Per Day who keeps parking in other people's spots and who takes out her recycling at midnight, dropping bottles all along the way, can't keep letting her recently evicted barfly boyfriends to "stay for a few weeks" whenever they need it. Or if she does, they can finally get rid of the woman and her 5 cats.

Now, that said, you still don't want to leave yourself open to it, so give them a call, explain it to them, and also make sure you say that to be able to get his visa, he'll need to pass background checks by both DHS and the State Department. You can provide copies of whatever documents you will give to them.

I sincerely doubt that they are going to take a good tenant who has a special situation and who is pro-active and up front about it, and be unable to run a background check because of the special circumstance and say "too bad now you need to leave".

I've been the main leaseholder and sublet but never owner/landlord.

I don't mean like "don't worry, rule won't apply to you" just that they're likely not looking to play "gotcha" with a good tenant who is upfront about a changing situation. 2 days is an awfully short visit to require a background check and to me reeks of "covering ourselves to be able to get rid of troublemakers if we need to" or to avoid people running an Air B&B from the property rather than "oh, look 4B had her mom stay for Memorial Day weekend without a background check, out she goes!" I've lived in 3 different rental properties and have never had such a strict requirement in terms of guests. Two weeks I think was the request before.

Sorry I haven't been able to get back to the thread. I really appreciate everyone's replies and it helped put my worries at ease. I will be talking to my landlord about it on Monday. I will let you know what she says.

I will make sure when the time comes, that my fiance has an extra copy of the police report. I have always been transparent with my landlord about issues and have always paid my rent on time, etc. So she doesn't have anything against me that I know of! I was just concerned because I didn't understand that if she never dealt with something like this before, if she didn't know what to do, what I could tell her to convince her otherwise that it's no big deal.

Like Boiler said, the landlord does the reference checking. They can use and online application like Sterling Back Check as I often do in Canada for credit and criminal checks for candidates from around the world. (I work in HR) Good you are doing it the right way....better for sleeping at night . Back Check is international but can limit as well to just one country.
