Hello my VJ friends!

So, i am hoping someone out there can help with my question... sorry if it is a repeat, I promise i did look through recent posts first!

I plan on speaking with a tax professional about this as well (as i know that the deadline is coming up), but do i need to report my income in Canada as well as in the USA? I know that as a CR-1 visa holder, I need to report my global income to the IRS. My visa took 16 months to process, so I wasn't prepared to move the second that it was issues, so I maintained working in Canada, commuting back and forth. I was not out of the US for over 330 days in a 12 month period.

Just super confused if i should speak with my bookkeeper in Canada, or my tax specialist in the USA.

Any assitance would be greatly appreciated!

Thanks!

As a person who has had permanent residence in the US since 6-18-2015 you are required to file a US tax return if you earned income anywhere. There is a tax treaty with Canada that will spell out who gets to collect your tax. Usually it is the place where you live, meaning if you live in the US, you pay the US and don't pay Canada. That is just a generic statement and not a fact I have studied about Canada specifically. Read this IRS publication to find answers maybe.

Publication 597- Information on the United StatesCanada Income Tax Treaty https://www.irs.gov/pub/irs-pdf/p597.pdf

For 2015, you might be considered a dual status alien where you pay half and half. See Publication 519 for info on that.

Or you can choose to be a U.S. Resident for tax purposes for the whole year (because you married a USC) and file jointly with your wife. Also in Pub 519.
