Hey,

I was wondering if anyone could answer this question for me - I am a US citizen and got married in Canada and was planning to apply for I130 from US but looks like the processing times are different in different locations. I was wondering if we could apply outside the US for 130 and sending it to New Delhi or California since the processing times are faster.

You are the petitioner and lie in the US correct. So you would be sending your petition to either the Chicago or Phoenix lockbox depending on what state yo live in.

Expect 5 to 7 months at USCIS for approval then your petition is sent to NV for more processing. Where does your husband want to have his interview India or Canada?

Expect about 12 months fr the whole process from filing to interview.

This whole process is confusing to us, however next month were visiting india and India's processing time is faster than here and since we will visit there we were planning on processing from there... since the processing time is faster there is it possibility to apply from there is there a chance?

If that is a possibility then we were planning on just having him do the interview in India.

Incase that doesnt work he can interview from canada from the montreal office since he lives there.
