My husband was

petitoned by his us citizen brother thru f4 category..he is now in the us with green card..my son and i are follow to join derivatives, and our visa is ready..now my brother in law refused to provide aos due to some reasons..can a family friend provide aos instead?

do you mean the petitioner will not send his affidavit of support for you and your son?

, the joint sponsor doesn't have to be a family member, it can be anybody over 18, who is a USC or LPR that qualifies, but if it is the petitioner, he must send his affidavit of support for you? If he doesn't make enough, he can use a joint sponsor

but you need the petitioner's affidavit of support to bring you here

what's the problem and what does your husband say?

unfortunately no, without his affidavit of support the petition cannot continue

if he isn't willing to continue the petition, your husband will have to file a petition for you, the family friend could be your husband's joint sponsor

in that case you would have to forget about this petition and wait over a year to come, how old is your son?
