K1 for a Romanian living in Japan

I haven't started the process but will soon, and I need a couple of questions answered if at all possible.

Background:

She (Romanian) was married to a Japanese man and separated some years ago. She is still living in Japan and has just convinced him to sign the divorce papers (He's very influential and does not want the divorce for reputation reasons). (but he was philanderer and she has plenty of proof so he was forced to sign or have it be public in court)

So here are my questions:

If she has divorce papers in Japan where the marriage took place will she still need to make sure that the marriage is not registered in Romania before I submit for the visa?

I understand that she will need to in Romania for the interview and we are preparing for that but because she does not have a job in Romania we are hoping to wait until just before she has an interview. Will that be an issue?

If she resides legally in Japan then that is where she should interview. If she's legally divorced that should be enough.
