1/CR-1 SPOUSE VISA CASE SEND BACK TO USCIS

Felling desperate case was “refused” at US consulate in Cuba back in August 21, my husband received back his passport with a 221g saying:

Your application for visa is being denied under section 221(g) of the Immigration and nationality Act as the claimed relationship between you and the petitioner exists for immigration purpose only. The petition on filed in your case is being returned to USCIS with recommendation that it be revoked.

Since then case was send to NVC on December and then to USCIS on January finally I received a Notification on February 3:

There has been a recent processing action taken on your case.

Receipt Number: LIN…..

Application Type: I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE (E), OR ORPHAN

On February 3, 2016, the Department of State sent us your case, Receipt Number LIN…., for review. We are reviewing it, and will notify you by mail when we are done. Please follow any instructions in the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

My question is what is next? Do I need to hire a lawyer? Do I need to send more evidence to help then make a decision?

Once the casefile gets back to the USCIS they should send you a NOIR or NOID (notice of intent to revoke or deny) and tell you what they need to make a decision on the file. I suggest a great deal more evidence you are a genuine couple. You will have a time limit in which to reply. Search the forum for similar cases, there are a few.

case already at USCIS since february 3 do they take 6 month or more to send you the NOIR or NOID or they send it right again you submit the evidence and then waint for the 6 month i am confused..

It varies. They do it on their own timelines. Patience, as always, is a virtue.
