My fiance is from the phillipines but she works on a cw visa in Saipan. If I submit the I-129f can she remain in Saipan while it processes (6 months) or does she have to wait in the phillipines? I know she has to do her interview, medical, police records, etc in phillipines but during the long until process can she remain in saipan and keep working? Thank you.

You do know that Saipan is US territory, right?... so while she is there she is considered to be in the US. Does she have permission to be in Saipan? If not, then she should go home, otherwise she will be considered to be in the US illegally.

You do know that Saipan is US territory, right?... so while she is there she is considered to be in the US. Does she have permission to be in Saipan? If not, then she should go home, otherwise she will be considered to be in the US illegally.

Why are you assuming that his fiancé was there illegally? A little judgmental much?

Yes your fiancee can continue to work in Saipan while the petition is processing, she can even process her visa application there IF she has legal status there at that time (work visa may cause an issue with this) of the visa application. She does NOT have to complete the visa application in the Philippines... IF, IF.

1) If your fiancee wants to process her visa in the Philippines make sure to NOT list her current address as in Saipan as NVC will send the case file there, list her address as her home address in the Philippines. 2) If your fiancee is going to process her visa in the Philippines she should make sure to get a police clearance from Siapan before she returned to the Philippines (this will make things much easier).

not assuming anything I said if she has a work visa, and then I said if she does not THEN she MIGHT be considered to be there illegally. I explored all sides of the situation because the OP did not provide that info.

Thank you very much for your link. Saipan is one of the Northern Mariana Islands, the U.S. commonwealth in the Western Pacific. So while you won't see Saipan on that drop down menu, the Northern Mariana Islands do appear there. Also, I know she is considered to be on US territory because I personally worked on a case where a non-US resident married someone who was born in Saipan and then adjusted status through marriage.
