came one month ago on k1 ,things didn't work out ,no marriage.

started to know some one else .

can i stay with the new person for the next 2 months and then leave just before my visa expires ? or do i have to leave now ?

how soon can i file for a new k1 visa with the new person ?

do i have to cancel the petition from the first visa first ?

It sounds like you are the beneficiary of the K-1. In that case, you cannot start a K-1, your new friend would have to do that.

Has the original petitioner canceled the petition? Is it amicable between you?

As for staying for the full period on your K-1: I do not have a suggestion.

Her's is quite a bit different, as she is currently in the US, she arrived 1 month ago, is still under the 90day expiry of the K-1, and has already moved on to another person. I really don't know what to say, the more experienced VJ'ers will have the knowledge you need.

07/04/15 - First Trip to China to visit her (spent time at her home, her hometown, and Beijing), Met the whole family.
07/18/15 - Sadly I had to return back to the US
10/01/15 - I am returning back to China to be with her again
10/11/15 - She will accompany me back on the same flight for 30 days
11/14/15 - She returns back to China
12/01/15 - I-129F Fed-Ex'd to the Lewisville address
12/03/15 - Packet signed for by the receiver

01/28/16 - NVC Received (Still waiting papers for official date)

SSN filed somewhere after this point (exact date is not remembered, received after a 30 minute wait)

02/28/17 - EAD and AP Approved
03/02/17 - NOA2 for EAD and AP Arrived

It sounds like you are the beneficiary of the K-1. In that case, you cannot start a K-1, your new friend would have to do that.

Has the original petitioner canceled the petition? Is it amicable between you?

Some other things to keep in mind.

If the petitioner cancels the petition, then USCIS will be able to match the cancellation date to your date of departure. I'm not sure if this counts as an overstay because it is so unusual.

The nightmare for every USC who petitions to bring someone to USA is that the beneficiary gets here and then takes off. We only get one side of the story here so do not expect a lot of sympathy. My advice is to not get self-righteous and play the victim. Just be polite until you have the information you need to make your life decisions.

Because of that, as discussed in the other thread, your second K-1 will be heavily scrutinized. Follow the suggestions in that thread.

Based on what you have learned and now that you are not in a hurry to file a second K-1, then I suspect you can let the first K-1 just expire but others here are more knowledgeable.

The one-way, one-time K1 visa was voided at her US Port of Entry (POE). Her current 90 day legal stay is totally due to her I-94. She should return home and have her new USC petitioner file a new I-129F petition. It would be advisable to get the previous one taken care of prior to going for another. Either way, I suspect there will be several red flags raised due to this arrangement. Best to get your ducks in row now.
