Hello VJers,

I have a situation I want to run by you all seeking advice. I am a USC filed a petition for my mom which is in final stages at the NVC. My mom and Dad separated when I was a child. I only know my stepfather.

My question is can my mom file for him (stepfather), his children from another relation at the same time?

Or do they need to wait for father to file for them? Can they be included in same petition as their father (all under 21).

I supposed they divorced not separated, right? because she needs to be divorced and file copy of the divorce decree with the petition

yes she can file for him and the children under 21 as stepchildren, they will come as his derivative

as long as the marriage took place before the children were 18, she can file as stepmother
