Hey everyone, I need some help!

I'm eligible to apply for citizenship based on marriage and I was about to do so, when we received a letter from the IRS!

For the past 3 years I filed taxes jointly with my husband, we always paid our taxes, never owed the IRS etc.

But then we received a letter saying we owed a bunch of money (from 2013), because my husband's former boss committed fraud and falsely claimed that my husband made waaay more money than what he actually did!

My husband has tried to contact the guy several times and he pretty much avoided him and stalled him for 2 months. Now my husband had enough and is meeting with a lawyer today so this can be settled.

We're probably gonna have to go to court against that guy and it's probably gonna take a while to settle this.

My question is: would I have problems if I applied for citizenship now?

Because technically this is all happening to my husband (not me), but we do file taxes jointly...

Should I wait until this is settled?

I was so excited that I was about to end the last phase of this immigration battle and be done for good (we all know how stressful this is) and now this happens! it's so frustrating!

No matter what, your Social Security Number comes up that you owed tax with IRS. I mean, you can apply for citizenship right now, but, if I were USCIS, I will put your case on the side and wait until everything is settled and I want to see the outcome of the lawsuit (if applicable). USCIS is neither IRS nor the judge, so they do not know whether you owed the tax or not. In this case, I strongly suggest that you need to talk to your lawyer and see what will happen then.

Go ahead and apply for your citizenship, and check the box that state you owe taxes, since you do legally through this mess. Owing taxes is not necessarily a bar to citizenship provided you can show proof you're making payment to the IRS as with a payment plan arrangement. You'll be given a chance on the day of your interview to explain and submit extra proof and outcomes of this scenario. Good thing is it's gonna be months ahead of time to sort this out. The worse that will happen is a decision will be made to hold your petition pending and given an RFE, till you've satisfied such a requirement through a payment plan as mentioned or otherwise.

12/05/2017: Package delivered in Phoenix, AZ. Transferred to Harrisonburg Processing Center.

12/07/2017: Notice of action issued. (IOE)

12/26/2017: Biometrics.

01/23/2019: Interview Scheduled for 2/27/2019.

02/27/2019: Joint I-751/N-400 interview. N-400 recommended for approval.

05/16/2019: N-400 APPROVED! Placed in line for oath ceremony.

05/17/2019: Oath ceremony notice mailed.

06/12/2019: Swearing in Ceremony! Finally a U.S. citizen!

You can apply now for citizenship but check the box that says you owe the irs money. You can do a couple of things. You can wait until this mess clears up and then file for citizenship or you can apply now and have your lawyer type a letter stating what had happen. Send the letter with your n-400 application but make a copy of the letter for your records. Good luck.
