Hi there,

We're due to get married in the coming weeks and shortly after will fill out the appropriate forms for my green card application (AOS) with forms I-131, I-485, I765, I-693 etc

She is a US citizen and wants to take my last name (I'm from the UK)

The question is, are there any draw backs to changing her name (when we get married) - and right before we apply for AOS? The forms ask for social security number, alien registration number as well as other details (for her) - and we weren't sure if this would lead to any problems.

If she does change her name on marriage, which name would have to go on the forms?

If any one has any experience with this - we'd really appreciate your thoughts and opinions.

Since it is the USC's name and won't be appearing on the green card, then the name on the paperwork for her doesn't matter much either way. The USCIS sees you are newlywed and would have a pretty good idea she had a recent name change. The marriage license shows why her name is different. People do it both ways.

If you use the married name now, you won't be coming back in 2 years (removing conditions) and 3 years (citizenship) and posting "My wife used her maiden name for my AOS. If she uses her married name now, will USCIS think I married a different woman since AOS?"

We have the same situation and I used my new married name on the forms that asked for name and provided maiden when asked like on the G-325a. All of our supporting docs like my letter from employer and tax transcripts have my maiden name. We have not received a RFE and most October filers have gotten if they had issues.

I did go and have my name changed on my social security card and all other docs since we filled. Only have my passport left to do.
