I am a Canadian and my wife is the American. I'm wondering if anyone has ever been denied at the I-130 stage due to criminal history? I'm filing my G-325a out and it asks for my A number. Now I have one because I need a wavier to enter the USA, as I admitted to minor drug years ago at the border but have a clean record.. which technically makes me inadmissible but a lot of people have still gotten through if it's minor. I'm worried about being denied at the I-130 stage and not getting to see an officer..

I'm wondering if I put my A number down will they review it and potentially deny me then? Or if the risk of being denied is at the interview.

You know the answer, you need a waiver. Without the waiver you will be denied.

Not being truthful on forms can carry a lifetime ban. So choose carefully before completing the forms.

We filed a K1 so it's a bit different but we were approved at the I-129f/USCIS stage but then the beneficiary was denied at the interview/embassy stage. We then filed our waiver and are now awaiting the decision.

You can begin preparing the waiver to get a head start if you want, but cannot file it until you're denied.
