Social Security Office Giving Major Grief

I posted this in the general AOS-type forum, but haven't received a response. Maybe someone here can help me. <3

My husband and I were married this Saturday (wee), and he went to get his Social Security card today (Tuesday). He was unable to obtain it prior because he's only been in the country 16 days.

He gave the individual all required information (passport, I-94) and they told him that because we are now married, his K1 visa is NULL AND VOID and cannot be used to obtain a SSN. Now, I know this is completely crazy because many people here have had no problems with that. He tried telling them this and they wouldn't hear it, and repeatedly stated that because we were married, he's not a fiance so his visa is not applicable anymore. It does not expire until May 2007.

He's very upset about how misinformed the staff was and we are trying to find a document on the SS website that states something that will help our case. We cannot find evidence that they are correct or incorrect...just lots of stories of how people have had no problem obtaining their SSN after marriage and before the visa expires.

I've read the long general SSN piece that someone posted in other threads regarding SSNs, but that doesn't really answer my question.

Any suggestions or statutes you can throw my way would be greatly appreciated. I just sent a complaint to Social Security, but I'm sure that will get me far. :P

05/28/2008 - Received AOS Interview notice

07/10/2008 - AOS Interview-APPROVED pending fingerprints

09/22/2008 - GREEN CARD IN HAND!

Removing Conditions

06/04/2010 - Sent I-751

06/07/2010 - NOA1

06/09/2010 - Check cashed

07/22/2010 - Biometrics Appointment

09/08/2010 - Card production e-mail

I'm not sure of the official rules on getting the SS after you are married... I think you have to do AOS to get it.

If you are in Chicago, there are a couple SS offices, just go to a different one, and dont mention that you are already married. :whistle: They'll do it that way.... and a week later he'll have his SS card.

By the way, I went to the Chicago downtown SS office, they didnt ask us a single question. Just handed passport with I-94, she did some typing and told us the card will arrive in 1-2 weeks... and it did.

Weird, we thought they only office was the one up at the Damen and Lawrence area. I'll instruct him to go to a different one and hopefully that will work.

This is usually a female problem, because married women tend to apply for their SS card using their husband's surname.

Form SS-5 does not ask for marital status. Have your husband take his ring off (if you gave him one), send him to a different SSA office, and tell him to keep his mouth shut.

Excellent! I'm glad he managed to get it!

I applied for mine AFTER marriage also but I had no problems...I wonder why this is an issue?
