hi all,

I am ready to do the fedral tax ( married filing joint w/ foreign spouse ),w-7,and supporting documentation ready.

my question is this.

For the state filing , do I have to wait for the ITIN # to be assigned from the I.R.S to send in the state form?

If you have any experiance or insite I would greatly apreciate your input.

I-751 timeline

3/05/10 - mailed I-751 packet

3/12/10 - arrived at CSC

3/16/10 - online status, NOA mailed but no mail received

3/18/10 - Check cashed

4/15/10 - biometric appointment (notice recv'd in mail - 4/01/10)

4/16/10 - touched

4/18/10 - I-485 & EAD touched????

5/03/10 - Card production ordered

5/11/10 - letter of Approval received in the mail

5/26/10 - email received "letter of Approval" sent in the mail... not yet received till now 6/8/10

7/07/10 - called USCIS why green card has not received yet

7/09/10 - email from USCIS stating that they already sent the GC on May 25th and undeliverable,

adviced to apply for I-90 as it might have been lost in mail

7/25/10 - mailed application for I-90 (replacement of lost or stolen card)

9/16/10 - biometric appointment

9/20/10 - touched

9/21/10 - touched

Are you using Form 2555 to exclude you wife's foreign income? I didn't. :blush: My wife is *well* below the limit but I didn't learn about that exclusion form until a few days after I mailed off my taxes.I'm almost expecting my taxes to be returned to me for it or worse yet to be audited.

Are you using Form 2555 to exclude you wife's foreign income? I didn't. :blush: My wife is *well* below the limit but I didn't learn about that exclusion form until a few days after I mailed off my taxes.I'm almost expecting my taxes to be returned to me for it or worse yet to be audited.

Actually, you can not use the Form 2555 for your wife. The Form 2555 for the USC and the resident alien to exclude overseas income. Our SOs are not the resident alien yet untill they are here.

I am thinking that I may send in the fedral with the w7 and if they give the itin # soon I will get extension on state then isert the # and send it off...how does that sound???

If you are the one who must attach Federal returns for Calif. return.....those who are itemizing or other reasons, it is a good idea to attachW7.

And, even, you are not required to attach Federal for Calif. return, I think it is also a good idea to attach W7. But make it sure to write "for your information only" on W7, so that Calif. Franchise Tax Board would not be mislead having you filing W7 to FTB.

I think two things would be taking place later. 1) FTB will ask you ITIN # later. In this case, you just mail FTB a copy of the letter from IRS form CP-565A which is assigning ITIN#. 2) FTB and IRS may be sharinng information. So, this case, you do not have to do anything.

From last year or so, do you remember, we ,even, do not have to attach W2 to Calif. return any more. Not only that, the employers do not have to submit W2 and 1099 information to Calif. anymore. I think that they may be sharing some information.

I was given instructions to attach a copy of the W-7 and Certification cover letter to the back of the California return.

In the place where it asks for SSN of spouse I put "ITIN applied for" on the 1040 & 540.

All this was done with the assistance of an "Authorized IRS Acceptance Agent" IRS Acceptance Agents for W-7 Certification

California does not require attachment of the Federal Return (they have access to that info).
