Hello.. I am a Filipina. Was married to Canadian man 2006 here in the Philippines..

2008 he divorced me in his country.

I got a divorce decree and also a certificate of divorce from Canada.

I am living now with my US CITIZEN partner for 6 years here in the philiines but planning to move to US..

We are planning to apply for fiancee visa, do you think I will get an approval?

I also filed a recognition of divorce but still waiting for the decision. We are thinking to start our fiancee visa application. Is there anyone here that has the same situation?

You and your fiance can file the I-129F petition IF both of you are free to marry.

I am really free to remarry. Because I am already divorced . Just this Philippine law that's su$$$$ks?

We have to suffer and spend lots of money for this recognition of divorce here in the Philippines

Did you record the divorce with NSO (PSA) ? Did your Canadian spouse file for the divorce? It would be good to get that recorded with NSO (PSA)... removes any change of issues in the future.

For the visa process you do not need to have your divorce decree recorded at NSO (PSA), having copies of the divorce decree is adequate for USEM. Not sure how CFO will look at that though.

You would save tons of time if you got the divorce recognized (by filing at NSO) and then getting married in the Phils being you both have been living there for years. The visa process is only about 60 days for a DCF, compared to almost a year otherwise.

You won't have any problem getting a visa.

Your only potential problem is whether the CFO will require an annulment or a recognition of a foreign divorce. However, I have not seen any similar cases here on Vj where there has been a problem with the CFO. It seems that a divorce decree satisfies their requirements. It is likely that you don't even need to get an annulment or a recognition of a foreign divorce.

I hope someone with a similar case will respond.

I filed a recognition of divorce because I heard that I can only remarry if my divorce is recognized here in the Philippines. i want to be totally free. But unfortunately I filed 2009 and still waiting for the decision!?

That's why I will never ever marry again here in the Philippines!

I don't think you need to have a court recognize your foreign divorce

First of all, the U.S. Embassy Manila will not require your divorce to be recognized. They only want to see your divorce decree.

Second, you likely have a CFO stamp already in your passport, so you should not need to attend the CFO seminar again. But, even if you had to attend the CFO seminar again, it's very likely that would accept your divorce decree, and they would not care if the court did not recognize your divorce.

If you did not have your divorce recognized, you would not be able to get married in 'pinas. But you said that you don't want to get married in 'pinas, so it's not an issue.
