My husband and I are filing for me to adjust status after getting married while I was in the states on the VWP/Esta.

It was an incredibly last minute and rushed decision, and I have a couple of questions that some people on here may be able to help with.

1) What evidence is suitable to prove my having employment back in the UK? I have spoken to my employers and they have been understanding of my situation. Will a letter on company headed paper with contact information for the business owner be sufficient?

2) What evidence may I submit for my still having a home in the UK? I am not on the tenancy for the flat I live in back in the UK as a friend took me in and I have just paid her rent for the past year and a half so can't get a letter from a lettings agency; she is technically my 'landlord'.

I think that is it for now. I understand I need evidence I entered the States with intent to return to the UK so if anyone can suggest the suitable types of evidence I could use that would be really useful.

I was under the impression that after marrying on a tourist/holiday visa a necessary part of the application process to adjust status would be to prove I did not intend to stay in the USA from the beginning/to prove ties back home?

Sorry if I have been misinformed.

Eighteen years in the US and I still don't understand Velveeta, TV ads for prescription drugs, only getting 2 weeks paid vacation, or why anyone believes anything they see on Fox "News".

The process from adjusting from VWP is the same as for adjusting from any other non-immigrant, non-family-based visa. The guide is here.

You're not the first person to AOS after entering on the VWP and you won't be the last. If you explore the forum I just moved your thread to, you'll find it's discussed quite frequently. Here are a few examples:

Here's the USCIS Policy Memorandum on AOS from VWP It'll give you a detailed understanding of the official USCIS position on adjusting status after entering on the VWP, although I have to admit it's not the world's most gripping read...

If you want further reassurance, Google "Matter of Cavazos". The Board of immigration Appeals held that preconceived intent alone was not sufficient grounds for denying an adjustment application that would otherwise have been approved.

Breathe. Stay calm, follow the instructions in the guide and ask here for help with anything that isn't clear. You're going to be okay :)
