Hi there,

We sent in the I-129F on September 30th and received notification that they got it and were forwarding it to the CSC. Yesterday my fiance and I received a NOA I-797 saying that the petition has been approved and that the original visa petition is being sent to the NVC. Do we now just wait for correspondence from the NVC? Not sure what the next step is and I want to make sure I get everything correct. At the bottom of this notice it says that when I enter the USA next then I have 90 days to marry. Is that what I need to do now? I thought it takes longer to get to this point?

I actually have the same question! Ours was approved on the 6th and I am not sure when to expect the NVC to receive the case. Also what exactly happens at the NVC with the case? My lawyer is already getting the affidavit of support ready to be sent out when it is needed. She tried explaining to me what happens at the NVC but I was having trouble understanding.

Wait the reasonable requisite amount of time on the NOA2, I think it says 30 days for it to goto NVC and them to redirect to the appropriate Consulate/Embassy. Don't waste your time calling the next day cause they dont have it and they dont know any more than you...so relax.

Then call the NVC and dont wait for their correspondence cause it will take way longer to wait for it. The line will be busy or you'll get an awful we're too busy bug off message. Keep calling and call at odd hours. They are staffed longer than most govt things so the off hours you'll have better luck than say over your lunch break. When you get a human, ask for your numbers and case status. Track your status on the CEAC tracker https://ceac.state.gov

You have not gotten NOA2, NOA1 just says they got your stuff. I can certainly take a LOT longer.

Ok so I will wait and will call the center after 30 days (or wait until I hear back). Can I still enter the USA while this is going on? I have to go back and forth for work.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

So I am looking at this flow chart, up until what point can I NOT enter the USA. As I mentioned earlier, I travel down to the USA for work a lot and need to know when I am unable to cross the border due to jeopardizing my status/case.

Your OP was ambiguously open ended. After reviewing some of the links above and getting the process down. I suggest you search the forums for some of your other questions, such as this traveling to work. There is the Canadian subforum here http://www.visajourney.com/forums/forum/93-canada/ and lots of canadian users which I am sure someones encountered this situation before. Canadians commute across the border to work daily, how this affects your case I dont know, from reading threads seems like experiences up N w/ the border can vary somewhat.

Canada would be a bit weird as I assume one is rather freely able to go to / from. However AFTER you get your K1, you'd be locked down until you got your EAD/AP to work here/go back.
