I am getting ready to file for my fiancée in January 2016. This year I will have at least four tax returns. One from McDonalds, then going to a temp agency and getting a job, then rolling over onto that job's payroll, and now I moved to Minneapolis for a better job making a lot more money.

However, I am afraid that my W-2 for this year will not show the 125 percent needed for approval because I've had pay increases from job to job and a week or two where I wasn't working waiting to start the next job. The job I am at now I will stay at for a long time.

My question is: as long as I stay at this job now and show pay stubs, letter of employment and earnings projected for the year of 2016 going way above the 125 percent, will that be enough to substantiate the income requirement since my W-2 may not show it?

It's not projected earnings you need to show, it is CURRENT earnings. If your current income is above the poverty guidelines, and your pay stubs and employment letter verify that, then you should be ok.

It's not projected earnings you need to show, it is CURRENT earnings. If your current income is above the poverty guidelines, and your pay stubs and employment letter verify that, then you should be ok.

So Tax Returns are really not required? My fiance and I were worried. Hes pay is more than above the poverty guide, he also have W2, and he can get a letter from his employer. But he have issues with his taxes and stopped paying it about 3 years ago. We just filed ours this November and waiting for NOA2. Should we worry about his tax returns? Thank you foy your help

You are not understanding things correctly. You will not have four tax returns for this year. You can only have one tax return per year. You will report the income from the W-2s for those four jobs on one tax return.

Current income is what matters. Pay stubs, letter of employment and projected earnings above the 125% poverty line will help you meet the I-864 requirements on your own. The W-2s from your prior jobs are not going to matter. You will still need to provide your latest tax return no matter what - even when it does not show adequate prior income.

Tax returns are required. Dave345 must provide his latest tax return.

Your fiancee is required to declare that he filed tax returns for the last 3 years and provide his latest tax return. Making "more than above the poverty guide" requires him to file tax returns.

You should be very worry about this. No tax returns equals no visa for you. If your fiance wants you to get a visa, then he must file his tax returns for the last three years.

Thank you. Ive been telling him about it, that he should settle it but he is not that good with paper works and I also dont know how to help him in filing his taxes. I think he also wont beleive that we need it until Im done with the interview, or until I got disapproved.. Maybe that will encourage him to deal with it when I got disapproved.

Philippines embassy is hit and miss on wanting any tax or financial information.....

Many people are not being required to show anything related to work or finances....

Thank you.. I was also thinking of that and read it somewhere that they dont require sometimes.. I also posted on Philippines regional portal... but we will just try.. we will see when we get our noa2 and apply for affidavit of support. Thank you so much..
