Hello all! My ex was the one who dealt with all the paperwork and such regarding my immigration, so forgive me if I'm a little rusty regarding all of this. A little background before my question, I got my 10 year green card (first) December 2012, and I'm currently separated from my spouse. Forgive me if this has already been asked, but I thought I would ask with my specific situation to get some clarification...

To my understanding, you have to wait 3 years from getting your green card if you're married in order to apply for naturalization, and 5 years if unmarried at the time. Since I'm technically married, but not "living in marital union", I would assume that means I have to wait until December 2017 in order to start that process? Also, a few months ago I relocated from KS to IL, is that going to affect me in any way down the road in this regard? Please forgive me and feel free to correct me for any information I may be misinformed about. Thanks!

(Also, if someone could direct me to the form and/or information regarding the naturalization process, that would be awesome!)

Here's the VJ guide for naturalization :)

Yes, you'll have to wait five years before naturalizing if you're separated from your husband - you're only eligible to naturalize after three years if you've been living "in marital union" with the USC spouse for the three years prior to application and continue to do so from the date of application through to the naturalization interview.

I'm not aware of any issues that could be caused by your move, but you should notify USCIS of your change of address even though you don't currently have any active petitions. You can do that online here.

Eighteen years in the US and I still don't understand Velveeta, TV ads for prescription drugs, only getting 2 weeks paid vacation, or why anyone believes anything they see on Fox "News".

Thank you both for you quick responses! I have to head out to work shortly here, but I will be sure to check out reporting my change of address when I get back. Greatly appreciated! Oh and also, I'm the husband in this situation. ;)

the 3 year rule applies to you only if you have lived in a marital union with your spouse for the whole 3 years. even if you have been living together and now separate you will be asked about it. Its goes for example from today to 3 years going back starting today. I hope I delivered my thought lol So you want to go with the 5 year rule so your marriage won't be a major effect on your naturalization.

file the change of address form and declare your moving. Moving will not affect your naturalization process unless if you didn't live in the same district where you are filing for at least 3 months before filing. So say 2 years from now you moved again, you have to make sure you lived in that same USCIS district area for at least 3 months.

Good luck.
