Hi everyone, recently our I129f petition was approved. Today i received a letter from manila embassy stating all details and procedures on how to do about with the application of visa as the case is already in the embassy. Unfortunately and sadly my fiance in america doesnt want to continue with the process anymore as his work will require him to travel overseas and he wont be able to do the reaponsibilities that is attached with the whole process. 4 mos ago before the K1 petition was approved, i was contacted by a teacher-exchange program i once applied to to join using a J1 visa but i needed to say no at that time in anticipation of the K1 process. Now that our relationship has ended, i once again signed up for the exchange program and will possibly apply for a J1 visa months from now. My question is, since an approved I 129f is pending in the embassy, will this affect my future application of J1 visa? What could be done so that the approved I129f petition could not hinder my future plans to go with a J1 visa? Thanks a lot for those who have time to read and respond to my inquiry.

I'm sorry to hear that. As a beneficiary you can't officially cancel the process since the I-129F is handed by the petitioner.

The best you can do is not respond to any requests from USCIS or the embassy if it gets that far. You can respond to them if you'd like with a letter stating that you no longer have a relationship with your fiance and do not wish to continue with the K-1 process. If you do meet someone in the future and they need to file for you, they will have to disclose that another person petitioned for you in the past. Other than that there isn't much you can do. Eventually the application should run it's course and your ex will receive the denial notice.

Well I really hope you get accepted on your exchange program.

Only your X -fiance can cancel the I-129F petition. If during the J1 process it will come up, you just have to explain truthfully what happened.

You may also write back to the US Embassy in Manila in response to Packet 3 you received, tell them what happened and inform them that you cannot continue to process the K1 visa.

Better things will come.

All i want is life to go on and the exchange program accepted my application again should there be an opportunity next time. I just want that this k1 visa processing not to hinder to my future opportunities. So maybe ill ask my ex fiance to write to the embassy. Thanks a lot.

Your X should cancel the petition; but I know that contacting him about this will cause more heartaches. If you don't want to do it, just email US embassy Manila yourself.

Just be strong, I believe everything happens for a reason. Ohh ok good to know that. I havent even opened the packet 3 yet. I just dont have the strength yet. So if i dont do anything with it and when applying for a J1 visa, ill just explain that it didnt work for us and bring copy of his emails stating he didnt want to continue with k1 anymore, do you think its just going to be ok? Yeah, that's all that you can say. It was his decision and there was nothing you can do. You are acting in good faith, don't worry about it.

If I may asked, when did your received packet 3? How long from NOA 2? I am not actually waiting for mine since I have my case number already but I was wondering when I will actually get it.

We got noa2 on aug 28... After 3 wks, he called nvc and got our case number. We paid to already schedule the interview until he decided he will have to accept job overseas. I got packet 3 october 22. You dont have to wait dor packet 3 though to go on with your interview. Just a screen shot of the status being ready for interview.
