Hello everybody!

I'll start by sharing some background information about myself and my fiance, how we met, and our current status.

I (Cody) am a US citizen, born and raised in Hawaii, 25 years old. My fiance Lesley is Canadian, 27 years old. Lesley and I met very casually via social media about 2 years ago. We chatted now and then, sharing stories and common interests. Not like every day via phone calls, skype, or anything like that. Not until around April of this year we really started talking serious and wishing so badly that we could be together.. Until finally Lesley decided to come see me in Hawaii.

August 6th. Lesley came to Hawaii, only for a week, which we spent all day everyday together. We completely fell in love and I promised her I would do whatever it takes to be together again! I knew the day she left that I had to go to Canada, so I booked my ticket!

September 27th. Im going to Canada! Very surprised how lenient customs was as I didnt even recieve a stamp on my passport. A bit worried about this, we did research and found that as a US citizen I am allowed to stay in Canada for 180 days just with a passport. (My return flight is Dec.31 btw)

It didnt take long for us to decide that we want to get married. So we told our families the news, and began planning. Our current plan is to go back to Hawaii together on the 31st. We just got our I-129F and are getting ready to begin the process.

So heres where I have a few questions. Many of which I have searched and read about on this forum, but I would like to clarify any confusion being that there are so many different stories to read.

1. Is it a problem for me to be in Canada for the next 2 months if we submit our application now?

2. Lesley is worried about going to Hawaii during the application process even though we intend on doing everything correctly and lawfully, knowing that she will have to come back to Canada to finalize the K-1 visa.

So if we apply now, and it will take about 5 months - We go to Hawaii in 2 months, so basically she is on Vacation until the I-129F is approved and then returns to Canada, meaning she will be in Hawaii for about 3 months.

From what I've read in the forums is as long as she can prove that she has no intention of violating any type of immigration or visa laws ex. having a round trip ticket and something like a bank statement showing that her savings are still in Canada untill the K-1 is complete and we make the final move.

Any advice would be greatly appreciated, as we would like to do this the best way possible while trying to avoid spending too much time apart.

Thanks

1. Do you have someone checking your mail in Hawaii during your absence?

2. Not a worry. As insurance, have her carry a copy of your cover-letter for the I-129F.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Aloha!

Expect fast K1 processing since your case will be processed in CSC. My then fiancé (now hubby) petitioned me thru K1, and our case didn't take 5 months to complete, we are from Hawaii too (Waikiki). Our NOA2 got approved just 10 days after NOA1 and I was in US within 3 months since we filed our petition. Just make sure someone will get your mail when you're away on vacation. Good luck!

Nevermind previous question, I have that answered already.

My current dilemma is this-

Me and my fiance are currently in Canada. We are basically ready to submit our I-129f. What we are trying to figure out now is how to go about the payment process because it needs to be a check or money order from the US. I dont have any checks here with me... Do I have a check mailed here from home and then included with the I-129F, or should I send the I-129F to my home adress in Hawaii then have someone write a check and send everything to the lockbox facility from there?? My main concern is wherever the I-129F is sent out from will be considered the return address for any receipts or future documents coming from the CSC..correct?
